  13. Please read these conditions before using the software. If you use the software
  14. you agree to become bound by these conditions. If you do not wish to do so, do 
  15. not use the software.

  17. DRS Systemtechnik License Agreement
  18.  
  19. In return for acquiring a license to use the software ("Software") and related
  20. documentation, you agree to the following terms and conditions:
  21.  
  22. 1.    License. This Agreement grants you, the Licensee, a license to:  
  23.     (a) use each the software on a single computer system or, 
  24.     in the case of a multi-user or networked system which permits access
  25.     to the software by more than one user at the same time, at a single 
  26.     working location; 
  27.     and (b) make one copy of the Software in machine readable form solely 
  28.     for back-up purposes provided you reproduce DRS Systemtechnik's
  29.     copyright proprietary legends.
  30.  
  31. 2.    Restrictions.  You may not distribute copies of the Software to others
  32.     or electronically transfer the Software from one computer to another 
  33.     over a network.  You may not use the Software from multiple locations
  34.     of a multi-user or networked system at any time.  The Software
  35.     contains trade secrets and in order to protect them you may not decom-
  36.     pile, reverse engineer, disassemble, or otherwise reduce the Software 
  37.     to a human-perceivable form.  YOU MAY NOT MODIFY, ADAPT, 
  38.     TRANSLATE, RENT, LEASE, LOAN, RESELL FOR PROFIT,
  39.     DISTRIBUTE, NETWORK OR CREATE DERIVATIVE WORKS
  40.     BASED UPON THE SOFTWARE OR ANY PART THEREOF.

  42. 3.    Ownership of Software.  As Licensee, you own the media upon which the
  43.     software is recorded or fixed, but DRS Systemtechnik retains title and
  44.     ownership of the Software recorded on the original media and all 
  45.     subsequent copies of the Software, regardless of the form or media in
  46.     which or on which the original and other copies may exist.  This 
  47.     license is not a sale of the Software or any copy.

  49. 4.    Confidentiality.  You agree to maintain the Software in confidence and
  50.     to not disclose the Software to any third party without the express
  51.     written consent of DRS Systemtechnik.  You further agree to take all
  52.     reasonable precautions to preclude access of unauthorized persons to 
  53.     the Software.

  55. 5.    Term.  You may terminate the license at any time by destroying the 
  56.     Software (including the related documentation) together with all 
  57.     copies or modifications in any form.  DRS Systemtechnik will have the 
  58.     right to terminate your license immediately if you fail to comply with
  59.     any term or condition of this Agreement.  Upon any termination, 
  60.     including termination by you, you must destroy the Software 
  61.     (including the related documentation) together with all copies or 
  62.     modifications in any form.
  63.  
  64. 6.    Limited Warranty.  DRS Systemtechnik warrants only that the media upon
  65.     which the Software is furnished will be free from defects in material
  66.     or workmanship under normal use and service for a period of thirty
  67.     (30) days from the date of delivery to you.  DRS SYSTEMTECHNIK DOES
  68.     NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU
  69.     MAY OBTAIN BY USING THE SOFTWARE OR DOCUMENTATION.  
  70.     THE FOREGOING STATES THE SOLE AND EXCLUSIVE REMEDIES DRS 
  71.     SYSTEMTECHNIK WILL PROVIDE FOR BREACH OF WARRANTY.
  72.     EXCEPT FOR THE FOREGOING LIMITED WARRANTY, DRS 
  73.     SYSTEMTECHNIK MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, 
  74.     AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, 
  75.     MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  
  76.     Some states do not allow the exclusion of implied warranties or 
  77.     limitations on how long an implied warranty may last, so the above 
  78.     limitations may not apply to you.
  79.     
  80. 7.    Limitation of Liability.  IN NO EVENT WILL DRS
  81.     SYSTEMTECHNIK BE LIABLE TO YOU FOR ANY SPECIAL DAMAGES, 
  82.     INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER 
  83.     INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF DRS 
  84.     SYSTEMTECHNIK HAS BEEN ADVISED OF THE POSSIBILITY OF
  85.     SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
  86.     
  87. 8.    Limitation of Remedies.  DRS Systemtechnik's entire liability and 
  88.     your exclusive remedy shall be: (a) the replacement of any media not
  89.     meeting DRS Systemtechnik's limited warranty which is returned to 
  90.     DRS Systemtechnik; or (b) if DRS Systemtechnik or its distributor is 
  91.     unable to deliver replacement media which is free of defects in
  92.     materials or workmanship, you may terminate this Agreement by 
  93.     returning the Software and your money will be refunded.
  94.  
  95. 9.    General.  You acknowledge that you have read this Agreement, 
  96.     understand it, and that by using the software you agree to be bound 
  97.     by its terms and conditions.  You further agree that it is the 
  98.     complete and exclusive statement of the agreement between DRS 
  99.     Systemtechnik and you which supersedes any proposal or prior 
  100.     agreement, oral or written, and any other communication between 
  101.     DRS Systemtechnik and you relating to the subject matter of this 
  102.     Agreement.  No variation of the terms of this Agreement or any 
  103.     different terms will be enforceable against DRS Systemtechnik unless 
  104.     DRS Systemtechnik gives its express consent, including an express 
  105.     waiver of the terms of this Agreement, in a writing signed by a 
  106.     Chairman of DRS Systemtechnik.  You assume full responsibility for
  107.     the use of the Software and agree to use the Software legally and 
  108.     responsibly. All rights in the Software not specifically granted
  109.     in this Agreement are reserved by DRS Systemtechnik.
